Welcome to Gacha Goat (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our other policies referenced below.
1. Eligibility & Account
You must be the age of majority in your province, state, or country of residence to use the Services or make a purchase. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account.

3. Products & Availability
All products (including collectibles, trading cards, and accessories) are subject to availability and may be limited in quantity. We reserve the right to discontinue any product at any time, and to impose limits on quantities per order, per person, or per household to protect availability and fairness.
4. Orders & Acceptance
Your order constitutes an offer to purchase. We may accept or decline your order in our sole discretion, including for suspected fraud, pricing or inventory errors, or policy violations. If we cancel an order after your payment has been captured, we will issue a refund to your original payment method.
5. Pricing, Taxes & Errors
Prices are displayed in the currency indicated on the site and are subject to change without notice. Applicable taxes and shipping charges will be calculated at checkout. We do our best to ensure accurate pricing and product information; however, errors may occur. If an error is discovered, we may cancel or correct the order and will notify you.
6. Payments
We accept the payment methods shown at checkout. By submitting payment information, you represent and warrant that you are authorized to use the selected payment method and authorize us or our payment processor to charge the full order amount, including any applicable taxes and shipping fees.
7. Shipping, Risk of Loss & Title
Shipping options, timelines, and carriers are outlined in our Shipping Policy. Title and risk of loss for products pass to you upon our delivery of the order to the carrier. Tracking may take up to 24–48 hours to activate.
8. Returns, Refunds & Exchanges
Our returns and refunds process is described in our Return Policy. Certain items are final sale or otherwise non-returnable as stated in that policy.
9. Preorders & Backorders
Estimated release or restock dates are provided for convenience and are subject to change by manufacturers or carriers. Orders containing both in-stock and preorder/backorder items may ship separately.
10. Acceptable Use
You agree not to misuse the Services, including by: (a) violating any laws or third-party rights; (b) attempting to circumvent purchase limits, security, or access controls; (c) using bots, scrapers, or automated tools without permission; (d) uploading malicious code; or (e) interfering with other users’ access.
11. User Content & Reviews
If you submit reviews, images, or other content (“User Content”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such User Content in connection with the Services and our marketing. You represent that you own or have rights to your User Content and that it is accurate, lawful, and non-infringing.
12. Intellectual Property
All content on the Services, including text, graphics, logos, product images, design, and software, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
13. Third-Party Services & Links
Our Services may contain links to third-party sites or integrate third-party services (e.g., payment processors, carriers). We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
14. Promotions & Loyalty Programs
From time to time, we may offer promotions, discounts, or loyalty benefits (e.g., “Join the Herd”). Such offers are subject to additional terms, may change without notice, and may be discontinued at any time. Misuse or suspected abuse may result in revocation.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
16. Limitation of Liability
To the fullest extent permitted by law, in no event shall Gacha Goat, its owners, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of the Services or purchase of products. Our total liability for any claim shall not exceed the amount you paid for the applicable product(s) or CAD $100, whichever is greater.
17. Indemnification
You agree to indemnify, defend, and hold harmless Gacha Goat and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms or your misuse of the Services.
18. Governing Law & Dispute Resolution
These Terms and your use of the Services are governed by the laws of the Province of Quebec, Canada, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the courts located in Quebec for any disputes arising from or relating to the Services or these Terms.
19. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for any violation of these Terms. Upon termination, the rights granted to you will cease immediately.
20. Changes to the Services & Terms
We may modify or discontinue the Services, in whole or in part, at any time without notice. We may also update these Terms from time to time. The “Last updated” date indicates the effective date of the current version. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
21. Severability & Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with any policies referenced herein (including our Return Policy and Shipping Policy), constitute the entire agreement between you and us regarding the Services.
